Is a Crypto-to-Crypto Swap Taxable? 14 Countries Compared

Swapping BTC for ETH or USDT is taxable in the US, UK, Germany, Spain, Canada and Australia but deferred in Portugal, Austria, Italy and Poland. Country table.

Whether swapping one crypto for another is taxable depends on where you are tax resident. In the United States, the United Kingdom, Canada, Australia, Spain and Germany (for coins held a year or less) a swap is a disposal: you realise a gain or loss on the coin you give up, measured at the value of the coin you receive. In Portugal, Austria, Italy, Poland and France the tax is deferred until you leave crypto for fiat or spend it. In Switzerland private gains are not taxed at all, and in the Netherlands the sale is not the taxed event. Stablecoins count as crypto everywhere in this list, so moving into USDT is a swap, not cashing out.

Why countries disagree

The split comes from how each tax system classifies crypto. Countries that treat crypto as property or a capital asset apply their general rule that bartering one asset for another is a sale of the first asset. Countries that wrote specific crypto rules, mostly in Europe from 2019 onwards, chose to tax the moment money leaves the crypto system. Portugal and Austria explicitly carry the cost of the old coin into the new one. Italy limits the exemption to crypto-assets with the same characteristics and functions, which leaves room for debate about some tokens.

France is a clear example of the deferral model. Under article 150 VH bis of the General Tax Code, exchanges between digital assets are not taxed; tax arises on a sale for fiat or a purchase of goods or services, and the gain is calculated with a formula based on the total value of your whole crypto portfolio at that moment, not lot by lot.

Worked example: one swap, four outcomes

You bought 1 ETH for $2,000 eight months ago. Today you swap it for 2,450 USDT. In the US, you report a short-term gain of $450. In Germany, the euro equivalent of that gain is taxable unless your total private sale gains for the year stay within โ‚ฌ1,000. In Portugal, nothing happens now: the USDT inherits a $2,000 cost and the original date. In Poland, nothing enters PIT-38 until the USDT is sold for money. The tax lot calculator helps you track the cost that carries over, or the gain that arises, depending on your rules.

Common traps

  • Stablecoins are not cash. Moving profits into USDT or USDC is a swap. In the swap-taxable countries it triggers tax just like selling for dollars.
  • Wrapping can be a swap. Turning ETH into WETH or BTC into WBTC is treated as a disposal by some authorities, including the Australian ATO, because ownership of a different asset changes hands. See what a wrapped token is.
  • Network fees paid in crypto can themselves count as a tiny disposal, for example under HMRC guidance, though the amounts are small.
  • Deferral is not exemption. In Portugal or Poland, a chain of swaps eventually ends in a taxable sale, measured from the original cost. Keep the records of the first purchase.

Records for every swap

Whichever group your country is in, keep a record of every swap: date and time, what you sent and received, the value in your currency, fees and both transaction hashes. On KOT.CASH the order page holds most of that; save the link. If you compare the cost of a swap with selling on an exchange and rebuying, the swap fee calculator shows the fees side by side, but remember that in swap-taxable countries both routes are taxed the same way.

FAQ

Is swapping BTC for ETH a taxable event?

In the US, UK, Canada, Australia, Spain and Germany (held a year or less), yes. In Portugal, Austria, Italy, Poland and France the tax is deferred.

Is converting crypto to USDT taxable?

Wherever swaps are taxable, yes. Stablecoins are crypto-assets, so converting into them is a swap, not a sale for fiat.

Which countries do not tax crypto-to-crypto swaps?

Among those compared: Portugal, Austria, Italy (same-function crypto), Poland, France, Switzerland (private gains) and the Netherlands (Box 3).

If my country defers swaps, when do I pay tax?

When you sell for fiat or spend the crypto. The gain is measured from the cost of the first coin in the chain.

Is wrapping ETH into WETH taxable?

Some authorities, such as the ATO, can treat it as a disposal. Check your country's rules for wrapping and DeFi.
